Terms of use

We are finalising this page. It will be reviewed by our legal adviser.

This page is in English. If you need help understanding it or want it in another format, contact privacy@equiva.io.

Part A applies to everyone who uses equiva.io. Part B also applies if you use the Equiva platform. If your organisation has an agreement with us, that agreement covers how we provide the platform to the organisation; these terms cover your own use of it. Nothing in these terms affects your legal rights as a consumer.

Part A — Everyone

A1. Who we are. equiva.io and the Equiva platform are provided by Equiva Ltd, registered in England and Wales, company number 17393531, registered office Blue Star House, 234–244 Stockwell Road, London SW9 9SP. Email: hello@equiva.io. [to be confirmed]

A2. Using the website. You may use this website to learn about Equiva and contact us. Please do not copy large parts of it, use automated tools to collect content from it, or do anything that harms it or other users.

A3. Information on the website. We try to keep the website accurate, but it is general information. It is not legal, medical or professional advice.

A4. Links. Links to other websites are for convenience. We are not responsible for their content.

A5. Changes. We may update these terms. We will show the date of the latest version at the top, and tell platform users about important changes in advance (see B12).

Part B — Platform users

B1. Who can use the platform. You must be 16 or over, and invited by an organisation that has an agreement with us (such as your college, training provider, programme or employer), or by us for a programme we run.

B2. Your account. Keep your sign-in details private and do not share your account. Tell us or your organisation straight away if you think someone else has used it. Your organisation controls who has access and can close accounts.

B3. Your content. You keep ownership of everything you create or upload, such as answers, reflections, evidence and your adjustments profile. You give us permission to store, process and display it only so we can provide the platform to you and your organisation. This permission ends when your content is deleted, except where we must keep it by law or under your organisation’s instructions.

B4. Our platform. The Equiva software, design and content belong to Equiva Ltd, which provides the platform directly. You may use them only to learn and work on the platform. Please do not copy, sell, reverse engineer or build a competing product from them.

B5. AI features. Eva and other AI features can help you, but they can make mistakes. Their answers are support, not professional, legal, medical or careers advice. Check anything important with your tutor, coach or another qualified person. Decisions that matter, such as assessment outcomes and support decisions, are made by people. AI can mark practice quizzes when your organisation allows it and your tutor or assessor switches it on for that quiz, to help you prepare. Final assessments are marked by your assessor and checked by quality assurers. AI marks never count towards your results or qualification.

B6. Possible-need review. The platform may notice patterns that suggest someone could benefit from extra support. These are suggestions for trained staff to review. Equiva is not a medical device [to be confirmed], does not diagnose any condition, and is not a substitute for assessment by a qualified professional such as an educational psychologist or clinician. Its outputs must not be relied on as evidence of a diagnosis or as the sole basis for any statutory, clinical or employment decision.

B7. Sharing with employers. Sharing your adjustments profile with an employer is always your choice, and you can stop sharing at any time. If you are an employer, you may only use what a learner shares to make adjustments or provide support. You must not ask a learner to share their profile, or use it to reject or treat anyone less favourably.

B8. Acceptable use. You must not:

  • try to access information or areas you are not allowed to see
  • upload anything unlawful, harmful, abusive, discriminatory or that you do not have the right to share
  • upload other people’s personal information unless you are allowed to
  • pretend to be someone else
  • try to make the AI produce harmful content, or get around its safeguards
  • upload viruses or harmful code, or overload or disrupt the service
  • use automated tools to access or copy the platform

If you see something that breaks these rules or worries you, report it to [to be confirmed] or your organisation.

B9. Suspension. We may suspend or limit an account if we reasonably believe these terms have been broken, or to protect users or the service. We will tell you and your organisation why, unless the law or safety stops us, and give you a chance to respond where we can.

B10. Availability. We work to keep the platform available and secure, but cannot promise it will always be uninterrupted or error-free. We may change features to improve the service, and will tell organisations about significant changes.

B11. Our responsibility to you.

  • If you use Equiva as a learner or for your own private purposes, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. Loss is foreseeable if it is obvious it will happen, or if we and you both knew it might happen.
  • We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else the law does not allow us to exclude or limit.
  • If you use Equiva as part of your job or business (for example as a tutor, assessor or employer), your organisation’s agreement with us sets out our responsibilities. If there is no such agreement, we are not responsible for loss of profit, business, revenue or opportunity, and our total liability to you is limited to [to be confirmed].

B12. Changes to these terms. We will give you at least [to be confirmed] days’ notice of important changes, by email or in the platform. If you do not agree, you can stop using the platform before the change takes effect.

B13. Complaints. Tell us at hello@equiva.io and we will try to resolve it quickly. Complaints about your personal information follow the process in our privacy notice.

B14. Law and courts. These terms are governed by the law of England and Wales. If you are a consumer, you can bring proceedings in England and Wales, or in your home part of the UK if you live in Scotland or Northern Ireland.

B15. General. If a court finds part of these terms unenforceable, the rest still applies. If we do not enforce a term straight away, we can still enforce it later.
